Business Valuations

Often times the divorce and family law cases present the issue of business valuation. This most often arises when a business was started during marriage or when one of the spouses had a business before marriage, but that business grew and improved throughout the marriage. Each of the scenarios presents different legal principles and requires differing analysis.

When a business was started during marriage, it is presumptively community. On rare occasions, this presumption can be rebutted but it extremely hard to do and requires specific elements of proof.

Assuming that the business was started during marriage, a business valuation expert will look at many factors of that enterprise. Among the factors the business valuator will analyze are the revenues of the business, assets of the business, liabilities of the business, what personal expenses are paid by the business for the benefit of the owners and how that business compares to other similarly situated concerns. These and other factors go into the final valuation of the business.

A different set of rules apply if one of the spouses had the business before marriage, but the business was improved during the marriage. In such a situation, the non-owning spouse has a "community lien" upon the appreciated value of the business during marriage. To determine the appreciated value is a complex endeavor. The appropriate business valuator must be employed to maximize our client's ownership interest in the business.
